Please read these Terms & Conditions carefully. By submitting your contact information, joining the founding member waitlist, or using any services provided by PNW Pickleball Club LLC, you agree to be bound by these terms.
1. About Us
PNW Pickleball Club LLC ("Company," "we," "us," or "our") is a Washington State limited liability company in the process of establishing an indoor pickleball facility in Kent, WA. Our registered email is cmotley@pnwpickleballclub.com.
2. Pre-Opening Status
PNW Pickleball Club is currently in a pre-opening phase. The facility is not yet open for business. By joining our founding member waitlist, you are expressing interest in our future membership program — you are not purchasing a membership or paying any fees at this time.
No payment, credit card information, or financial commitment is collected or required to join the waitlist. Membership agreements, pricing, and formal enrollment will be offered once the facility has a confirmed opening date.
3. Founding Member Waitlist
3.1 What It Means
When you submit your name and email address through our website or forms, you are added to our founding member interest list. This gives you:
- Priority notification when the facility opens
- First access to lock in the founding member rate of $59/month (subject to availability)
- Updates on facility progress, opening dates, and exclusive pre-opening events
3.2 No Guarantee of Availability
Founding member spots are limited. Joining the waitlist does not guarantee a founding member membership. Spots will be offered on a first-come, first-served basis at the time of formal enrollment. We reserve the right to limit the total number of founding member memberships offered.
3.3 Rate Lock Conditions
The $59/month founding member rate, if offered and accepted, will be locked for the duration of the member's continuous active membership. The rate lock is forfeited if membership lapses, is cancelled, or is not renewed within any applicable grace period established in the membership agreement.
4. Communications
By submitting your contact information, you consent to receive email communications from PNW Pickleball Club LLC regarding facility updates, membership opportunities, and promotional offers. You may unsubscribe at any time by clicking the unsubscribe link in any email or by contacting us at cmotley@pnwpickleballclub.com.
We will not sell, rent, or share your contact information with third parties for their marketing purposes. See our Privacy Policy for details.
5. Website Use
5.1 Permitted Use
You may use this website for lawful purposes only. You agree not to use the site in any way that violates applicable federal, state, or local law; transmits unsolicited commercial messages; or attempts to gain unauthorized access to any part of the site or its related systems.
5.2 Intellectual Property
All content on this website — including text, graphics, logos, and design — is the property of PNW Pickleball Club LLC and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission.

6. Assumption of Risk (Future Members)
Upon opening, participation in pickleball and other physical activities at PNW Pickleball Club carries inherent risks of physical injury. Formal membership agreements will include a comprehensive liability waiver and assumption of risk acknowledgment that members must sign prior to facility access. These terms will be provided at the time of enrollment.
7. Limitation of Liability
To the maximum extent permitted by applicable law, PNW Pickleball Club LLC and its members, managers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this website or your participation in the founding member waitlist program.
Our total liability to you for any claim arising under these Terms shall not exceed the total amount paid by you to us in the twelve (12) months preceding the claim — which, during the pre-opening phase, is zero.
8. Indemnification
You agree to indemnify, defend, and hold harmless PNW Pickleball Club LLC and its affiliates from any claims, liabilities, damages, judgments, or costs (including reasonable attorneys' fees) arising from your violation of these Terms or your use of our website.
9. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in King County, Washington, and you consent to personal jurisdiction in such courts.
10. Changes to These Terms
We reserve the right to update these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the website after any changes constitutes your acceptance of the updated Terms.
